There are three types of Wills:

• a standard Will;

• a testamentary trust Will; and

• mutual Wills.

We find that the majority of our clients require a testamentary trust Will. This is because they provide two extra categories of benefits over a standard Will.

These benefits are:

• incredible tax advantages for minors (i.e. your children and grandchildren – even those that are born after your death!); and

• when properly crafted, the ability to protect the inheritance you leave to your beneficiaries from claims such as family law claims, bankruptcy and protection should they be, or become, disabled.

Most people don’t plan their death or incapacity.

Almost always a Will is a key part of your estate planning, but really good estate planning considers much more. For example, did you know that:

• your superannuation;

• assets owned jointly with other people;

• family businesses; and

• assets owned by legal entities such as family trusts

In addition we will discuss who you would want to control your assets if you were alive but unable to control them yourself. And who would you want to make decisions in relation to your health care and lifestyle decisions if you were alive but unable to make these decisions for yourself.
